Delaying Prayer Beyond its Time

Some people are waiting in the mosque for Fajr Prayer.

Indeed, prayer has been decreed upon the believers a decree of specified times. (An-Nisaa’ 4: 103)

Question:

I sometimes miss the Dawn (Fajr) Prayer because I get up late. I may wake up at 9 or 10 A.M. I usually have his breakfast, brush my teeth, perform ablution, and then offer the prayer. So, I offer it after 20 minutes after getting up. Is what I am doing right?

Answer:

All praise is due to Allah, the Lord of the Worlds, the Beneficent, the Merciful, the Master of the Day of Judgment.

Answering this question, Sheikh Ahmad Al-Hijji Al-Kurdi, an expert in the Encyclopedia of Jurisprudence and a member of the Kuwaiti Ifta department of the Ministry of Awqaf and Islamic Affairs, states,

“Delaying the Dawn (Fajr) Prayer beyond its time that is after sunrise, is a great sin not just delaying it after your getting up. It is invalid to delay any prescribed prayer beyond its fixed time without a valid excuse. Almighty Allah says:

Indeed, prayer has been decreed upon the believers a decree of specified times. (An-Nisaa’ 4: 103)

Therefore, you have to go to bed early to be able to wake up for the Fajr Prayer. It is prohibited to stay up late after `Ishaa’  (Night) Prayer if you are quite sure that you won’t be able to wake up for Fajr Prayer on its time. If you do so, you are a sinner.

Offering the Fajr Prayer after its fixed time is considered qadaa’  (making it up) in case it is offered after sunrise even if it was before the Zhuhr (Noon Prayer) of that day due to the previous verse.

In case you have to stay up late or you are not able to go to bed early, you have to wait till the Adhan (call to prayer) of Fajr. Then offer the prayer before you sleep. If you sleep before offering the prayer, then you have no excuse and you will be regarded as a sinner.
